Customer Service Agreement

This Customer Service Agreement ("Agreement") is entered into between the Customer ("Customer," "Client," or "User") and Miles Financial Services Private Limited, a company registered under Indian laws, with a mutual fund distribution license registered with AMFI, ARN-280456 and its registered office at WeWork Galaxy, No. 43, Residency Road, Bangalore - 560025 ("Service Provider" or "Miles Wealth").

  1. Customer Acknowledgment

    a. Acknowledgment and Understanding:

    • I, the undersigned, confirm that I have fully understood the services offered by Miles Wealth.

    • Clicking ‘I accept’ serves as my digital signature, indicating my agreement to the terms of this Agreement, along with the respective Asset Management Company (AMC) offer documents, Miles Wealth’s Privacy Policy, and the Terms of Use.

    • My identity and transactions are authenticated through my login credentials (email ID/phone number and password). I acknowledge that any transactions authenticated by these credentials are considered to have been made by me.

    • Even after termination of this Agreement, I retain the right to conduct transactions directly with the AMC.

    b. Consent to Communication:

    • I consent to receive communications from Miles Wealth related to the setup and operation of my account, as well as marketing information.
       

  2. Service Commitments by Miles Wealth

    Miles Wealth agrees to:

    • Adhere to Know Your Customer (KYC) regulations by verifying customer information.

    • Facilitate the subscription and redemption of mutual fund units efficiently.

    • Distribute mutual funds that align with the user's financial needs.

    • Provide prompt responses to any inquiries regarding my online investment account.
       

  3. Compliance and Mutual Obligations

    a. Customer Responsibilities:

    • I commit to providing accurate information for my investment account and ensure that the funds I invest are from legitimate sources.

    • I will safeguard my login credentials and immediately report any unauthorized use.

    • I am responsible for making informed investment decisions, including reviewing the offer documents for mutual fund schemes.

    • I will seek independent financial advice when necessary.

    b. Service Provider Responsibilities:

    • Miles Wealth will fulfill all regulatory obligations to provide its services seamlessly and efficiently.
       

  4. Platform Registration Requirements

    • To use the services offered by Miles Wealth, I must register on the platform with a valid mobile number and email ID.
       

  5. Client Eligibility and Verification

    • Only individual/natural persons residing in India, who are legally capable of entering into binding contracts, are eligible to use the platform.

    • Eligibility will be verified based on the information provided by the Customer.
       

  6. Investment Transactions

    • Transactions will be processed promptly if instructions are received before the specified cut-off times.

    • My instructions will be electronically forwarded to the AMC for execution.

    • I understand that my banking institution may charge a fee for insufficient balances during transactions.
       

  7. Redemption Discrepancies

    • The redemption of mutual funds may fail due to discrepancies or mismatches in the user's information, including but not limited to name changes, invalid bank account details, unlinked Aadhar-PAN, or non-compliance with KYC regulations. In such situations, customers are encouraged to reach out to our customer support team. Miles Wealth will assist in resolving these issues to the best of our abilities and within the scope of our responsibilities.
       

  8. Termination

    • Miles Wealth reserves the right to terminate my account if I violate any terms of this Agreement.
       

  9. Non-Dispute and Indemnity

    • I agree not to dispute Miles Wealth for any actions beyond its obligations or for losses due to service unavailability, delays, or other reasons outside of its control.

    • I will indemnify Miles Wealth for any losses caused by providing inaccurate information or delayed instructions.
       

  10. Limitation of Liability

    • I acknowledge that Miles Wealth will not be held liable for any financial losses, errors, or omissions in judgment during transactions.
       

  11. Governing Law and Arbitration

    • This Agreement is governed by Indian law, and any disputes will be settled through arbitration in Bangalore.
       

  12. Disclaimer on Mutual Fund Investments

    • Mutual fund investments are subject to market risks. I understand that past performance is not indicative of future returns.

    • Mutual funds do not guarantee any dividends, and investors should read all scheme-related documents carefully.
       

  13. Further Consent
    I allow the Distributor to use my KYC details (name, PAN, age, address, and signature) for sending to the AMC for validation purposes and compliance with legal and regulatory requirements.

    I acknowledge that the signature available in KRA records will be used for verification, and in case of any issues, the AMC may take additional steps to validate my requests or reject transactions if necessary.
